Terms of Service
Last updated: 5 September 2026
These terms govern your use of the AI Business Platform (the "Platform") supplied by 720DegreeIT ("we", "us"). By subscribing to or using the Platform you agree to them.
1. What the Platform does
The Platform lets a business connect its own WhatsApp Business Account and use it to answer customer questions, take bookings, issue and collect signed agreements, and manage recurring debit order collections. It is supplied as software as a service.
2. Your account
- You must give accurate registration information and keep it current
- You are responsible for activity under your login credentials
- You must tell us promptly if you believe your account has been compromised
- You must be authorised to act for the business you register
3. Your WhatsApp Business Account
The WhatsApp Business Account used with the Platform belongs to you, not to us. Accordingly:
- You contract directly with Meta and must comply with the WhatsApp Business Messaging Policy and Commerce Policy
- Meta bills you directly for messages. We do not mark up, resell or absorb those charges
- Meta assigns a quality rating to your number. Sending unwanted messages can cause Meta to restrict or disable it. We surface your rating in the portal, but we cannot prevent or reverse action taken by Meta
- You may disconnect your account from the Platform at any time
From 1 October 2026 Meta charges for every outbound message, including free-form replies inside the 24-hour customer service window. The Platform is designed to minimise message volume, and shows your running spend in the portal, but the cost is yours.
4. Payments and collections
Where you use the Platform to collect debit orders from your customers:
- The merchant account with the payment provider is held in your name. Funds settle directly to you and never pass through our accounts. We are not a payment service provider or a third-party payment processor
- You are responsible for obtaining valid mandates, for the accuracy of every collection you authorise, and for handling disputes and reversals
- No collection batch is submitted until you have approved it in the portal. That approval is recorded and is your authorisation to collect
- You are responsible for complying with the applicable debit order rules, including DebiCheck authentication requirements
5. Your obligations regarding customer data
You are the responsible party for your customers' personal information under POPIA. We act as your operator. You must:
- Conclude our operator agreement before processing any personal information on the Platform
- Obtain any consent required, including for direct marketing under section 69 and for children's information under section 34
- Give your customers a privacy notice covering their use of the Platform
- Respond to data subject requests relating to your customers. We will assist you
- Not use the Platform to send messages to people who have not opted in
6. Acceptable use
You may not use the Platform to:
- Send unsolicited marketing or any message prohibited by Meta's policies
- Provide medical diagnosis, legal advice or financial advice through automated replies
- Collect money without a valid mandate from the payer
- Impersonate another business or person
- Break any applicable law, including POPIA, the Consumer Protection Act and the Electronic Communications and Transactions Act
- Attempt to access another client's data, or to probe, scan or test the security of the Platform without our written permission
We may suspend an account that breaches this section, with notice where circumstances allow and immediately where they do not.
7. Fees
- Subscription fees are invoiced in advance: monthly on the first day of the month they cover, or annually on the first day of the subscription year. Invoices are in South African Rand, exclude VAT unless stated otherwise, and are due within 7 days of the invoice date
- There is no setup fee, and we help new customers get started at no charge. Once you are live, work we do for you at your request, such as changing or rebuilding your setup, may be charged. We will quote you before we start and do nothing chargeable without your agreement
- Transaction fees may apply per successful collection, as set out in your subscription. They are added to the next monthly invoice for the month in which they were incurred
- WhatsApp message charges are billed to you by Meta, separately from our fees
- We will give 30 days' written notice before changing prices. Existing subscriptions keep their agreed price until the notice period ends
- Where an invoice is unpaid for more than 14 days after its invoice date we may suspend access. We will remind you before we do, and you can restore access by paying and sending your proof of payment through the portal. Your data is retained for 90 days from suspension
8. Availability
We aim for high availability but do not guarantee uninterrupted service. The Platform depends on third parties including Meta, payment providers and our hosting provider, and outages in their systems will affect it. We will give reasonable notice of planned maintenance.
9. Your data
- Your data remains yours. We claim no ownership of it
- You may request an export of your data at any time during your subscription
- On termination we retain your data for 90 days so you can export it, then delete it, except where a statutory retention period applies
- We use aggregated, anonymised usage data to improve the Platform
10. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act where it applies to you.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data, and our total liability in any twelve-month period is limited to the subscription fees you paid us in that period.
We are not liable for action taken by Meta against your WhatsApp account, for failed or disputed debit order collections, or for the content of messages your Platform sends on your instruction.
11. Termination
- You may cancel on 30 days' written notice. Fees already paid are not refunded except where the law requires it
- We may terminate on 30 days' notice, or immediately for material breach or non-payment
- On termination your WhatsApp Business Account is disconnected from the Platform and remains yours
12. General
- These terms are governed by the law of the Republic of South Africa
- The courts of South Africa have jurisdiction
- If any provision is found unenforceable, the rest remains in force
- We may update these terms on 30 days' notice. Continued use after that constitutes acceptance
